- Acceptance of Terms
By accessing or using this website and purchasing or participating in coaching services provided by Pat Kirkland Leadership, Inc. ("PKL"), you agree to be bound by these Terms and Conditions. If you do not agree with these Terms, please do not use this website or purchase our services.
By purchasing coaching services through this website, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. These Terms govern both your use of this website and your participation in coaching services provided by PKL.
- Services
Pat Kirkland Leadership, Inc. provides executive presence coaching, leadership development, professional mentoring, facilitation, keynote presentations, workshops, online programs, and related resources designed to support personal and professional growth.
Executive presence coaching is a collaborative partnership intended to strengthen leadership capabilities, improve effectiveness, clarify goals, and support professional growth. Coaching may include discussion, assessment, feedback, strategic planning, goal setting, accountability, and action planning.
Coaching is not therapy, counseling, legal advice, financial advice, medical treatment, or any other licensed professional service.
By purchasing coaching services, you acknowledge that coaching is a developmental process and that you remain solely responsible for your decisions, actions, and results.
Participant limits for group coaching are intentional and designed to provide individualized attention, meaningful discussion, and a psychologically safe learning environment.
To preserve the integrity of the coaching experience, everyone attending a coaching session or group program must be a registered participant. Observers are typically not permitted. Contact us for permission.
- Participant Responsibilities
Participants agree to:
- Participate actively, honestly, and professionally throughout the coaching process.
- Take responsibility for their own decisions, actions, and results.
- Complete agreed-upon action items or exercises when applicable.
- Arrive prepared and on time for scheduled sessions.
- Communicate respectfully with the coach and other participants.
- Respect the confidentiality of fellow participants in group coaching programs including the personal coaching videos from the program.
Participants understand that coaching outcomes vary based on individual commitment, implementation, circumstances, and effort.
- No Guarantee of Results
PKL is committed to providing high-quality coaching and leadership development services. However, no guarantees are made regarding specific outcomes, including but not limited to:
- Career advancement
- Promotions
- Income increases
- Business growth
- Leadership effectiveness
- Organizational success
- Personal achievements
Testimonials and case studies shared on this website represent individual experiences and should not be interpreted as guarantees of future results.
- Scheduling and Appointments
Coaching sessions are scheduled by mutual agreement.
Clients are responsible for arriving on time. Sessions beginning late due to client delay will conclude at the originally scheduled end time.
Virtual Coaching
Clients participating virtually are responsible for maintaining reliable internet access, appropriate technology, and participating from a reasonably private location.
Technical difficulties caused by the client's equipment, software, or internet connection do not automatically entitle the client to additional coaching time or refunds.
- Cancellation and Rescheduling
Individual Executive Presence Coaching
- More than 72 hours' notice: Sessions may be rescheduled without charge.
- Between 72 and 24 hours before the session: A cancellation or rescheduling fee equal to 50% of the session fee ($500) will apply.
- Less than 24 hours' notice or failure to attend: The full session fee will be charged.
Group Coaching Programs
- Client cancellations made fewer than 14 business days before the program begins are eligible for a 50% refund.
- Client cancellations made fewer than 3 business days before the program begins are non-refundable.
- If PKL cancels or reschedules a program and the participant cannot attend the new date, all fees paid will be refunded.
- Fees and Payment
Payment is due according to the agreed proposal, SOW, coaching package, or invoice.
Full payment is required to reserve coaching time and confirm participation unless otherwise agreed in writing.
Prices are subject to change without notice but will not affect services already purchased.
Failure to make timely payment may result in suspension or termination of coaching services.
Payments are processed through secure third-party payment providers. PKL does not store complete payment card information.
- Refund Policy
Unless otherwise stated in writing:
- Individual coaching session fees are non-refundable once payment has been received.
- Coaching packages are subject to the refund terms outlined at the time of purchase.
- Digital products, downloadable resources, assessments, and online programs are non-refundable except where required by applicable law.
- Confidentiality
PKL respects the confidentiality of coaching conversations and will not disclose client information except:
- With the client's written consent;
- As required by law; or
- When necessary to prevent serious harm.
Employer-Sponsored Coaching
When coaching services are sponsored by an employer or organization (the client), individual coaching conversations remain confidential between PKL and the participant unless otherwise agreed in writing or required by law.
General participation or progress updates may be shared with the sponsoring organization. Participant-specific information requires participant’s knowledge and consent.
Group Coaching
Participants are expected to maintain the confidentiality of other participants. While PKL fosters a confidential environment, confidentiality among participants cannot be guaranteed.
Electronic communications cannot be guaranteed to be completely secure.
- Recording of Sessions
To protect participant privacy and foster a psychologically safe coaching environment, coaching sessions, workshops, and group programs may not be audio recorded, video recorded, photographed, or otherwise reproduced without the prior written consent of PKL except for recording coaching sessions which are part of the program curriculum.
Likewise, PKL records coaching sessions as part of the curriculum and are not shared outside the PKL organization.
- Intellectual Property
All website content, coaching methodologies, presentations, assessments, worksheets, frameworks, videos, downloads, trademarks, logos, and related materials are owned by or licensed to Pat Kirkland Leadership, Inc.
All materials provided during coaching engagements remain the intellectual property of PKL and are protected by applicable copyright laws.
Materials are provided solely for the client's personal or internal organizational use and may not be copied, reproduced, modified, distributed, published, sold, licensed, or shared without prior written permission.
Leadership assessments and related reports are intended solely for professional development and coaching purposes. They are not psychological evaluations, employment assessments, or diagnostic instruments.
- Website Use
You agree not to:
- Use this website for unlawful purposes.
- Attempt unauthorized access to PKL's systems.
- Upload malicious software or harmful code.
- Copy, scrape, or misuse website content.
- Interfere with the operation or security of the website.
- Third-Party Links
This website may contain links to third-party websites for your convenience. PKL is not responsible for the content, services, privacy practices, or availability of third-party websites.
- Professional Standards
Pat Kirkland Leadership, Inc. is committed to providing executive coaching services with professionalism, integrity, confidentiality, and respect.
PKL strives to create an inclusive, respectful, and psychologically safe environment for every coaching engagement.
PKL reserves the right to suspend or terminate coaching services if a client engages in abusive, threatening, discriminatory, or disruptive behavior or otherwise interferes with the coaching process or the experience of others.
- Communication Between Sessions
Unless otherwise included in the purchased coaching package or agreed to in writing, communication between scheduled coaching sessions is limited to scheduling matters and brief coaching-related questions via email.
Additional coaching, consulting, or support requested outside scheduled sessions may be subject to additional fees.
- Disclaimer
Information provided through this website and during coaching engagements is intended for educational and professional development purposes only.
Executive presence coaching does not replace legal, financial, medical, psychological, or other licensed professional services. Clients should seek qualified professionals when specialized advice is needed.
- Limitation of Liability
Clients acknowledge that all decisions, actions, and outcomes resulting from executive presence coaching services remain solely their responsibility.
To the fullest extent permitted by law, PKL shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:
- Use of this website;
- Participation in coaching services;
- Client decisions or actions;
- Business or career outcomes;
- Lost profits, opportunities, revenue, reputation, or data.
PKL's total liability for any claim shall not exceed the amount paid by the client for the coaching services giving rise to the claim.
- Indemnification
You agree to indemnify and hold harmless Pat Kirkland Leadership, Inc., its officers, employees, contractors, affiliates, and representatives from any claims, damages, liabilities, losses, costs, or expenses arising from your use of this website, participation in coaching services, or violation of these Terms and Conditions.
- Privacy
Your use of this website is also governed by PKL's Privacy Policy, which explains how personal information is collected, used, stored, and protected.
By communicating with PKL electronically, you consent to receive communications related to your inquiries, purchases, coaching services and program participation.
- Force Majeure
PKL shall not be liable for delays or inability to perform services due to circumstances beyond its reasonable control, including illness, natural disasters, severe weather, governmental actions, internet outages, technology failures, or other unforeseen events.
When reasonably possible, affected services will be rescheduled at a mutually agreeable time.
- Changes to These Terms
PKL reserves the right to modify these Terms and Conditions at any time. Updated versions will be posted on this website with a revised Effective Date.
Continued use of the website or coaching services after changes are posted constitutes acceptance of the revised Terms.
- Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of Texas.
Any dispute arising from these Terms or the coaching services provided by PKL shall be subject to the exclusive jurisdiction of the state or federal courts located in Travis County, Texas.
- Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Entire Agreement
These Terms and Conditions, together with PKL's Privacy Policy, constitute the entire agreement between you and Pat Kirkland Leadership, Inc. regarding your use of this website and participation in coaching services.
